Terms and conditions

Important

RockRiver Expeditions will issue you with a kit list for your event when you book with us.

When you make a booking by paying a deposit or full payment we will send you a confirmation email.  At this point a legally binding contract is made and you agree to accept all of these Terms and Conditions.

In these Terms and Conditions, the words ‘RockRiver Expeditions’, ‘we’, ‘us’ and ‘our’ mean or refer to RockRiver Expeditions. The words ‘client’, ‘you’, ‘participant’, ‘your’ and ‘the lead name’ mean or refer to any person who enters into a contract with RockRiver Expeditions. The words ‘event’ or ‘events’ mean or refer to any activity package organised by RockRiver Expeditions.  You should accept these Terms and Conditions only if you have carefully read and understood the contents. The moment we receive your deposit we start to work on your event therefore, it is non-refundable. The person making the booking must be 18 years old or over and possess the legal capacity and authority to make the booking and accept these Terms and Conditions on behalf of everyone in their party. The lead name is responsible for the accuracy of any information provided. RockRiver Expeditions cannot be held liable for any problems that may occur from incorrect information that you provided.

The client(s) will at all times during the event in the interest of safety (which is paramount importance) promptly comply with all reasonable instructions or advice given to him/her by or on behalf of RockRiver Expeditions. If the client(s) fails to comply with such instructions or advice, RockRiver Expeditions and its sub-contractors reserve the right to exclude the client(s) from the course or refuse carriage of him / her at any time. RockRiver Expeditions does not accept any responsibility for any loss, expense or damage arising because of the client(s) failure to comply with the safety guidelines.

The client(s) shall provide suitable clothing, equipment and footwear. RockRiver Expeditions does not accept liability whatsoever for any losses, claims, injuries or liabilities suffered, incurred or arising as a result of any defect in or the unsuitability of any clothing, equipment or footwear provided by the client(s). All specialist equipment, where required, will be provided by RockRiver Expeditions.

RockRiver Expeditions will not be held liable nor accept any responsibility for any injury, death or problem that occurs while you are under the influence of alcohol or drugs. We have a zero tolerance policy towards drugs.

It is imperative that you advise us at the time of booking of any condition, medical or otherwise, that might affect you or other people’s enjoyment of the course. In order to make your booking, you confirm that you and all of your party are fit to take this course, and that you have declared to us any disability or special need which is likely to affect the progress of the course or the enjoyment for other people. Your booking is accepted on the understanding that you realise and accept the risks and hazards potentially involved in the course you have chosen and that you are mentally and physically capable of undertaking your chosen course. If, in our reasonable opinion, your chosen course is not suitable for your medical condition or disability we reserve the right to refuse your booking.

Cancellation by the Client(s)

Cancellations must be notified in writing and a response from RockRiver Expeditions provided.

The event commencement date is the date RockRiver Expeditions start to work on the event. This includes the planning phase, which may be before the specified event dates. From this date any cancellation of the event will incur the loss of the deposit.

In the event that RockRiver Expeditions is able to re-sell the event place prior to the commencement date of the event, the client will receive a full refund less 20% of the event cost to cover administration fees.

Refunds will only be made after the commencement date of the course.

In the event that RockRiver Expeditions is unable to re-sell the event place prior to the event commencement date the client will be charged the following cancellation fees:

  • If cancelled with more than four weeks before the event start date the client shall forfeit the deposit.
  • If cancelled with four weeks or less before the activity start date the client shall forfeit the full amount.

To cover this eventuality, we recommend an insurance policy that includes cancellation or curtailment of your trip or holiday.

Cancellation by RockRiver Expeditions

Although every attempt is made to ensure that events run as scheduled, in the event that RockRiver Expeditions need to cancel an event due to unsuitable conditions or other unforeseen circumstances we will notify the client as soon as possible.

RockRiver Expeditions will notify clients not less than seven full days prior to an event start date if an event needs to be cancelled because a workable minimum number of participants have not been reached.

Cancellation by RockRiver Expeditions does not affect a client’s right to a refund of travel costs that may have been incurred prior to the cancellation.

In the event of cancellation by RockRiver Expeditions clients will be offered the following options;

  • Full refund of the course fee paid.
  • Another course on different dates.

Photos and Marketing

You consent to us using still and video images of you taken during the course for advertising and promotional purposes in any medium we choose. You consent to us using any written feedback you give us in any form of marketing we choose.

Your Data

If you have given us permission to email you about our offers and events but you later change your mind, just let us know by sending an email to info@rockriver.co.uk and we will take your email address off our system.

We will only retain the medical information and emergency contact details you provide us with for the duration of your event.  This is to allow us to look after you in the event of an accident.  No later than 72 hours after the conclusion of your event, these details will be deleted or shredded accordingly.

Risks and Dangers

Whilst we maintain high professional standards of client care and safety, you must realise and understand that climbing, mountaineering, other mountain related activities, kayaking, canoeing and adventurous activities all take place in hazardous terrain with a danger of personal injury or death. The risks involved can be minimised but never entirely eliminated.

We therefore draw your attention to the following participation statements;

British Mountaineering Council’s (BMC) Participation Statement;

Hill walking and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.

British Canoe Union (BCU) Participation Statement;

“Canoeing and Kayaking are “Assumed risk.” “Water contact sports.” that may carry attendant risks. Participants should be aware of and accept these risks, and be responsible for their own action and involvement”.

When booking on any of our courses you must understand and accept the participation statements.

These Terms and Conditions and any contract to which they apply, are governed in all respects by English Law. They shall be subject to the exclusive jurisdiction of the courts of England. If any part of these Terms and Conditions is determined by a court to be unenforceable, the remainder of the Terms and Conditions shall be unaffected and shall continue in full force and effect.

As this information is made freely available on www.rockriver.co.uk and is clearly labelled on the homepage it is assumed that any booking received will have read and understood these terms and conditions.
